1. Grant of Rights

For consideration received, the Participant hereby grants to Carstairs Bagpipes and its legal representatives /successors (Carstairs Bagpipes) and assigns, the irrevocable, perpetual, and worldwide right to:

  • Capture photographs and 3D scans of the Performer’s / Participant’s likeness.
  • Create, digitize, modify, and reproduce these images and 3D models.
  • Fabricate physical and digital products from the recorded data, including:
    • 3D printable designs and digital assets.
    • Physical 3D printed figurines and statuettes.
    • Custom trophies, medals, and plaques.
    • Commemorative awards and recognition items.
    • Personalized merchandise, novelty items, and memorabilia.
  • Use, market, and sell these items to the Participant or third parties.

2. Traditional Attire & Instrument Compliance

The Participant agrees that the 3D capture will include instruments (e.g., Bagpipes, snare/tenor/bass drums) and uniform elements. Carstairs Bagpipes is authorized to clean up, modify, or digitally adjust the assets to fix minor uniform misalignments, instrument positioning, or structural issues to ensure 3D print stability.

3. Diversity, Backgrounds, and Traditional Display

The Producer is granted the right to display the resulting 3D figurines or digital models in a respectful manner celebrating the heritage, diversity, and global community of Highland dancing and pipe bands.

4. Ownership

Carstairs Bagpipes (and its legal representatives / successors) shall own all rights, title, and interest in and to the resulting media, including any digital assets or physical prints. This includes the right to modify, edit, or composite the images or 3D models.

5. Waiver of Compensation and Inspection

The Participant waives any right to royalties or other compensation arising from the sale or use of the images and 3D data. The Participant also waives the right to inspect or approve the finished product, including any written copy or 3D representation that may be created. If the participant subsequently wishes to purchase a product which incorporates their likeness they may do so at fair market value without having to pay a digitizing fee.

6. Release of Liability

The Participant releases and discharges Carstairs Bagpipes (and its legal representatives / successors) from any and all claims and demands arising out of or in connection with the use of the images or 3D models, including without limitation any and all claims for libel or invasion of privacy.
